Acceptance and Modification of Terms and Conditions

Thank you for visiting BeFab Be Creative, by using BeFab Be Creative.co.uk and all sub-domains, which are a service of BeFab Be Creative Limited, you are subject to the following terms of service ("Terms & Conditions").

BeFab Be Creative may modify the Terms & Conditions at any time. We will notify you of any changes to the Terms & Conditions by informing registered users by email and posting a notice on the homepage of the website. It is your responsibility to review these Terms & Conditions regularly, as by continuing to use the Site after changes are posted means you are indicating your agreement to be legally bound by these Terms & Conditions as updated and/or amended. If you do not agree with the Terms & Conditions, do not use this website or our service. Copyright Policy

BeFab Be Creative respects the intellectual property rights of others and we ask our users to do the same.

As our customer you are responsible for all images uploaded to the BeFab Be Creative site. You must own the copyright or have permission from the copyright holder to print and use the image, if you don’t you cannot use our service.

By using our service

    • You as the client have the legal right to reproduce / modify and use the image uploaded to BeFab Be Creative.
    • Image does not infringe copyright, trademark, trade secret or any other intellectual property right of any third party
    • The content does not infringe any law and does invade any individual's right of privacy or celebrity;
    • The content / image is not unlawful, harmful, threatening, abusive, vulgar, harassing, defamatory, obscene, pornographic, indecent, inflammatory, libelous, hateful, or racially, ethnically or otherwise objectionable.

BeFab Be Creative reserves the right to refuse to print any image at our discretion.

By using BeFab Be Creative service you are undertaking to indemnify BeFab Be Creative against all claims, damages, losses, liabilities and expenses incurred in relation to your or your representatives submission of any copyrighted work to BeFab Be Creative, which may infringe the copyright or intellectual property rights of others.

By sharing your design with BeFab Be Creative our clients retain the copyright and all intellectual property rights to the image. All images on our online and offline server are protected by physical and IT security controls including encryption, and these are reviewed regularly. Images held within our print server will only be kept for 6 months, they will be then deleted, if you wish them to be deleted any time before then please send us a email request to hello@befabbecreative.co.uk where this will carried immediately.

You acknowledge and agree that any data, materials or content, including but not limited to designs, text, photos, images, etc or other material contained or distributed on or through the website by BeFab Be Creative, is protected by copyright. You may not use, reproduce or distribute any Site Content without the authorisation.

In using BeFab Be Creative services you agree that any fabric printed which does not meet our high standards will be donated to a charity of our choosing, for instance Project Linus, where the fabric will be used to create comfort blankets for ill children to avoid being put into landfill. If this is not acceptable then please do not place an order with BeFab Be Creative, as we are not the Digital Fabric printing company for you.

Complaints

If you are in any way dissatisfied with your fabric/service, please Contact Us. All enquiries must be received within 5 working days from receipt of your goods.

Liability

Under no circumstances will BeFab Be Creative Ltd. be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise)

  1. Loss of data
  2. Loss of revenue or anticipated profits
  3. Loss of business
  4. Loss of opportunity
  5. Loss of goodwill or injury to reputation
  6. Losses suffered by third parties
  7. Or any indirect, consequential, special or exemplary damages arising from the use of BeFab Creative regardless of the form of action.

BeFab Be Creative may provide links to other Web sites or resources, you acknowledge and agree that BeFab Be Creative is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that BeFab Be Creative shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Members Accounts & User Conduct

Members Accounts

If you register on the Site, you will receive an email confirming the creation of a BeFab BeCreative account. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to

  1. Immediately notify BeFab BeCreative of any unauthorised use of your password or account or any other breach of security.
  2. Ensure that you exit from your account at the end of each session. BeFab BeCreative cannot be liable for any loss or damage arising from your failure to comply with this.
  3. You agree that contact and personal information provided to BeFab BeCreative account during the registration process and otherwise shall be accurate and complete. If there are any changes to your contact information, you shall promptly update your account information..

User Conduct

In using this Site, you agree:

  • not to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • not to threaten, intimidate, harass or otherwise abuse any other BeFab Be Creative user.
  • not to upload, download, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • not to disrupt or interfere with the security of, or otherwise abuse, the Site, or any services, system resources, accounts, servers, or networks connected to or accessible through the site or affiliated or linked websites.
  • not to access, tamper with or use non-public areas of the Site.

Upon placing any order through the Site, you acknowledge that BeFab Be Creative will review it and the Content it contains for adherence to our guidelines and compliance with the Terms and Conditions outline here. BeFab Be Creative shall have the right to refuse to fulfil any order for any reason and to remove any Content and or user accounts that violates our policies or is otherwise objectionable to us.

Colour Accuracy & Batch Production

BeFab Be Creative will not be held liable for any percieved flaws in colour accuracy where no prior sampling was undertaken by the customer. The only way to ensure colour accuracy of production lengths is by prior sampling on the relevent fabric. Whilst BeFab Be Creative will endevour to ensure minimal variation between batches of printing, it is impossible to negate this entirley due to the natural materials we work with. The customer understands and accepts that there may be some variation between print batches as a result.

Ink Safety - OEKO Tex Standard 100

BeFab Be Creative can confirm that ink used in our printing process meets the OEKO-Tex Standard 100. For further detailed information, safety sheets please Contact Us.  

Faulty Goods / Returns

Faulty Goods

Please remember we print the design you provide, we do not modify it in anyway. We always recommend that you obtain a sample print prior to any order to ensure your satisfaction and expectations. Please see our in-depth section on colour reproduction for guidance and reassurance.

We shall without question replace items that are shown to have defects or faults as a direct result of our manufacturing process. We will not accept returns for natural fabric prints that exhibit natural deviations.

BeFab Be Creative will not accept any liability for defects or faults occurring as a result of processing or after treatment by an external source, and will not accept any claims for any loss or issue arising thereafter.

Returns Procedure

All our fabric printed fabric and product production goes through a quality control process.  

Note that due to the bespoke nature of the manufacturing service we provide, unless there is a defect in the base fabric, (not including natural deviations that can be found in natural fibre fabrics, including but not exclusive to fabric slubs, flecking, changes in fibre texture) or a flaw in the print process, or if appropriate the manufacturer of the chosen product, returns will not be considered.

Any items, which are deemed faulty or incorrect, BeFab Be Creative must be notified within 5 working days of receipt, please Contact Us with your order details. Failure to do so will result in the order being accepted as correct. If deemed to be incorrect, it is the responsibility of the client to return faulty items. Items are to be returned to us at client’s expense using a traceable method, within 5 working days of the notification. Please note we do not accept any responsibility for loss in transit of any goods.

Items must be returned in the condition they were supplied, items must not be cut or altered in anyway, otherwise order will be considered as being accepted and refund or replacement will not be considered. Once items have been assessed, return delivery charge will be refunded to a maximum of £10.00 per delivery.

This policy applies to the personal information we collect through our website, in person at events and exhibitions.

The process of sharing your personal information with us and by continuing to use our website, you confirm that you have read and understood the terms of this privacy policy. BeFab Be Creative takes the responsibility of the personal information we have about you seriously and we endeavour to be transparent about how we handle it and give you control over it.

The Personal Information we collect and why

We only collect the personal information that allows us to provide and communicate the service and products that our customers expect from us.

BeFab defines personal information as information that could be used to identify you or another individual. We collect personal information in a number of different ways, we will explain further on in “How we use your personal information” how we collect the information and how it will be used

Information you share with us  

We collect personal information that you share with us when you contact us or interact with us through our website (placing an order), email, phone, and in person at stands or events we attend. During these interactions you may share with us your Name, Business Name, address, email, phone number and payment information when buying a product or service from BeFab Be Creative. We will only ever ask for information that is pertinent to the service / sale we are providing our customers.  

Information from your online Interactions

BeFab will collect and store some anonymous, aggregate statistics from all visitors to our website whether you actively provide us with that information or merely browse our website. The information we collect includes the internet protocol (IP) address of the device you are using, the browser software you use, your operating system, the date and time of access, the internet address of the website from which you link through to our website and information on how you use our websites or apps.  

We use this information so that we can see how well our website is working, how it is used and what our users look at most.   In addition we also collect information about how our customers engage with our promotional campaigns / advertising online, outside of our own websites (for example, on Google, YouTube and on social media).  

This information is, predominantly, collected through our use of cookies and similar technologies, see details below.

Our website uses cookies, "Cookies" are small text files that websites save onto your device via your web browser, they have been in operation since the 1990’s and are a widely used technology.   Any personal information that is collected using cookies will be used in accordance with this privacy policy. By continuing to use our website you accept that cookies will be set on your device.

Email Communications

As a user of our services who has opted in to our email communications, we will send communications by e-mail only as long as you are happy for us to do so. You can find out how to update or change whether you would like to hear from us, or stop us contacting you, in the section below titled ‘How can you change the way that we contact you?'  

We collect information about how our customers engage with our email communications, this includes, whether they were successfully delivered, whether it was opened, if links to relevant information regarding our service contained within the email were clicked and whether you have advised us not to contact you anymore by using the unsubscribe option which is included in all our email communications to our customers.

This information allows us to ensure that we stop sending your email communications when you ask us to, it also allows us to ensure that our email content is interesting and informative as possible.

Social Media

Social Media is an important way for us to interact with people / customers regarding our services, due to our service being very much a visual service. You can use our social media channels to contact us or let people know what you think of our service and products. It is a mechanism to allow our customers and ourselves to have a conversation that in turn allows us to better understand our customers and their requirements.

The information we collect from social media and online sites, including Facebook, YouTube, Twitter, Pinterest, sometimes includes personal information that has been put online and is publicly available. We make sure any information we use is properly credited to its source or is made anonymous.  

These online and social media sites typically have their own privacy policies explaining how they use and share your personal information. You should carefully review those privacy policies before you use these sites to make sure that you are happy with how your personal information is being collected and shared.

Information we collect at events

You may share personal information with us when you visit us in person at our studio or events that we may attend; such information includes your name, contact details (see the section above titled "Information you share with us").  

We may also film or take photographs at events/exhibitions, we will always display notices at these events to advise you that this may be the case

How we use your personal information?

The main reason for collecting and using your personal information is to allow us to deliver our service and products to our customers, where appropriate improve our service/products and our customer experience.

  • To respond to queries and requests;

  • Communicate with you regarding the provision of our service/products;

  • Undertake where appropriate customer surveys to help us identify where service/product improvements could be made;

  • As long as you are happy for us to do so, to tell you about events, activities / news on our website, newsletters and our social media platforms.

BeFab Be Creative will only send you marketing communications when you have told us that you are happy for us to do so.

If you hadn’t previously asked us to send you marketing communications, you can ask us to start contacting you (sometimes called an "opt-in") by:

Going to the BeFab Be Creative website and entering your email address to the “Subscribe to our Newsletter” or if you are placing an order on our website you will be given the option to “Opt In” subscribe to our newsletter.  

Changes to your preferences  

If you have previously said that you would like us to contact you ("opted-in") but would like to change or update the way that we do so, you can update your preferences by: Contacting us directly or you can use the unsubscribe option included in all our e-mail correspondence (on all marketing and support communications),

BeFab Be Creative will never sell our customers data to 3rd parties.

Links to third party websites – we may provide links to other websites that are not operated or controlled by BeFab. We have no control and are not responsible for the content on these sites, the 3rd parties are responsible for how they collect and use your personal information, these websites should have their own privacy policies and explain how your personal data is used. We do not endorse or make any representations about 3rd party websites.

Personal Information - How long do we keep it

BeFab will only keep your personal information for as long as we need to for the reasons given in this privacy policy and for as long as law requires us.

We will delete customer records for those customers who have not interacted with BeFab out with a 2-year period, including placing an order or opening a marketing email.

Customer / Client Controls and Choices  

BeFab where possible will give you control over the personal information we collect about you, to ensure it is accurate and reflects your preferences. You have the right to access, update and amend personal information that we hold about you. If you would like to change the way that we contact you, see the section above titled 'Change the way that we contact you about our products, services and support?'  

In certain circumstances, you can also:

  • Object to our use of your personal information for certain purposes;
  • Ask us to limit or restrict our use of your personal information;
  • Ask us to correct, remove or delete personal information about you; or

In the very unlikely event that we do suffer a security breach that compromises the protection of your personal information and we need to let you know about it, we will do so.
